Table of Contents

1. Introduction

1.1 Purpose of the Terms

These Terms & Conditions (“Terms”) govern your access to and use of the website https://roblieproperties.com (the “Website”), all related subdomains, mobile applications, digital platforms, and any services provided by Roblie Properties (“Roblie Properties,” “we,” “us,” or “our”). They form a binding legal framework designed to protect both your interests and the integrity of our premium real estate brokerage, consultancy, and marketing operations.

1.2 Acceptance of Terms

By browsing, registering an account, submitting an enquiry, scheduling a property viewing, or otherwise interacting with our digital ecosystem, you unconditionally accept these Terms. If you do not agree with every provision, you must immediately discontinue use of the Website and refrain from engaging our services. Your continued use constitutes an ongoing reaffirmation of acceptance.

1.3 Legal Agreement

These Terms constitute a legally enforceable contract between you (“User,” “you,” “your”) and Roblie Properties Pakistan. They apply whether you are a prospective buyer, seller, investor, developer, agent, or casual visitor. For corporate entities, the individual accepting on behalf of the entity represents and warrants that they have the authority to bind that entity.

1.4 Website Scope

The Website provides property listings, market intelligence, investment insights, virtual tours, photography, videography, interactive maps, AI-assisted property search, appointment scheduling, and related real estate services. The Website also facilitates connections with our advisory teams and property consultants. All services are offered subject to these Terms and any additional written agreements.

1.5 Relationship Between User and Roblie Properties

Use of the Website alone does not create a broker-client, agency, or fiduciary relationship. A formal engagement is only established through a separate, signed representation agreement, commission agreement, or service contract. Nothing on the Website constitutes an offer to buy, sell, or lease a specific property; all listings are invitations to inquire.

1.6 Entire Agreement

These Terms, together with our Privacy Policy and any signed supplemental agreements, constitute the entire agreement between you and Roblie Properties regarding the subject matter, superseding all prior oral or written communications. In the event of conflict, a signed written agreement prevails over these Terms.

1.7 Updates, Version Control, and Effective Date

We reserve the right to modify these Terms at any time to reflect legal, operational, or market changes. The “Last Updated” date at the top indicates the current version. Material modifications will be communicated via a notice on the Website or by email. By continuing to use the Website after the effective date, you accept the amended Terms. We maintain a version history internally; please review the Terms regularly.

Important Notice: The Website is not intended to provide legal, financial, or investment advice. Always seek independent professional counsel before making real estate decisions.

3. Eligibility

3.1 Age and Legal Capacity

You must be at least 18 years old and capable of forming a legally binding contract under the laws of Pakistan to use our Website or services. By accessing the Website, you warrant that you meet this age requirement. Minors may only use the Website under the supervision of a parent or legal guardian who accepts these Terms on their behalf. Any account registered by an underage user without proper consent will be suspended immediately.

3.2 Corporate and Institutional Users

If you are acting on behalf of a corporation, partnership, trust, or other legal entity, you represent that you have the authority to bind that entity to these Terms. The entity is jointly and severally liable for any breach by its authorised users. We reserve the right to request incorporation certificates, board resolutions, or memoranda of association to verify this authority.

3.3 Overseas Pakistanis and International Investors

Our services extend to overseas Pakistanis and foreign nationals interested in Pakistani real estate. By using the Website from outside Pakistan, you confirm that your use complies with the laws of your country of residence, including any foreign exchange or investment regulations. Roblie Properties does not guarantee that the Website or its content is appropriate or available in all jurisdictions.

3.4 Identity Verification and Account Verification

To enhance trust and combat fraud, we may implement identity verification procedures for certain services—such as submitting offers, scheduling high-value property viewings, or agent/dealer registration. You agree to provide accurate, current, and complete identification documents (e.g., CNIC, NICOP, passport) upon request. Verification is conducted in accordance with our Privacy Policy and, where required, applicable AML/KYC regulations.

3.5 Restricted Users

We may, in our sole discretion, refuse service, terminate accounts, or restrict access to anyone who violates these Terms, provides false information, or engages in conduct we deem harmful to our reputation or operations. Users previously banned from the Website are not permitted to re-register without express written consent.

Practical Example: An 17-year-old attempting to create an Agent account will be denied. Similarly, a company director must provide a board resolution before the company can sign a commission agreement.

4. Website Use

4.1 Permitted Use

The Website is provided for your personal, non-commercial use in relation to exploring and transacting real estate, unless you are a registered dealer, agent, or corporate investor with a commercial purpose explicitly approved by us. You may browse listings, use interactive tools, schedule appointments, and communicate with our consultants for legitimate property interests.

4.2 Prohibited Activities

You agree not to engage in any of the following:

    • Violating any applicable local, national, or international law or regulation.
    • Impersonating any person or entity, or falsely stating your affiliation.
    • Transmitting unsolicited advertising, promotional materials, spam, or chain letters.
    • Uploading viruses, trojans, worms, or any malicious code.
    • Attempting to gain unauthorised access to any portion of the Website, server, or network.
    • Interfering with the proper working of the Website, including overloading, flooding, or crashing.
    • Harvesting or collecting email addresses or other contact information of users by electronic means.
    • Using the Website to defraud, harass, threaten, or harm others.
    • Posting false, misleading, or defamatory property listings or reviews.

4.3 Automated Access, Scraping, and Bots

The use of robots, spiders, scrapers, or any other automated means to access the Website for any purpose without our prior express written permission is strictly forbidden. This includes extracting listing data, pricing, or images for competitive analysis or publication on third-party portals. We employ technical measures to detect and block such activities. Violators may face legal action under applicable cybercrime and intellectual property laws.

4.4 Security Testing and Unauthorised Access

You may not probe, scan, or test the vulnerability of the Website, nor breach security or authentication measures. Any unauthorised access to data, systems, or networks may constitute a criminal offence. In the interest of responsible disclosure, if you identify a security flaw, please report it immediately to our technical team. We may consider responsible cooperation without legal action, provided you do not exploit the vulnerability.

4.5 User-Generated Malicious Content

You warrant that any content you upload, such as documents or images, does not contain malware, ransomware, or any code designed to disrupt, damage, or gain unauthorised access. We reserve the right to scan all uploads and remove any file suspected of being harmful.

Business Explanation: Maintaining the integrity of our platform is essential. Scraping data undermines the investment we make in exclusive listings and professional photography. Prohibiting such activities protects sellers’ property information and our competitive edge.

5. User Accounts

5.1 Registration and Profile Accuracy

To access certain features—such as saving favourite properties, receiving personalised alerts, dealer registration, or client portals—you may need to create a User Account. You agree to provide truthful, accurate, and up-to-date registration information and to update it promptly if it changes. Incomplete or false details may lead to suspension or termination.

5.2 Account Security, Passwords, and Two-Factor Authentication

You are responsible for maintaining the confidentiality of your login credentials. Do not share your password with any third party. If two-factor authentication (2FA) is enabled, you agree to use it and secure your second factor (e.g., phone or authentication app). Any activity occurring under your account is your responsibility. Notify us immediately if you suspect unauthorised access. We cannot be held liable for losses arising from compromised credentials.

5.3 Termination, Suspension, and Deletion

We reserve the right to suspend or terminate your account at any time, with or without cause, including for prolonged inactivity or violation of these Terms. You may request deletion of your account by contacting our support team. Upon termination, your right to use the Website ceases immediately. However, certain provisions of these Terms shall survive termination, including intellectual property, disclaimers, indemnification, and limitations of liability.

6. Property Listings

6.1 Availability and Accuracy of Listings

We strive to present complete, accurate, and current property information. However, the real estate market is dynamic; properties may be sold, withdrawn, or have price changes without immediate Website update. Listings are for informational purposes only and do not constitute a legally binding offer. We recommend verifying all critical details directly with your assigned property consultant before making decisions.

6.2 Pricing, Measurements, and Descriptive Information

All prices displayed are in Pakistani Rupees (PKR) unless stated otherwise. International currencies shown are approximate conversions for reference only. Room dimensions, plot sizes, and total area measurements are approximations based on information provided by sellers or developers and should be independently verified. We disclaim liability for typographical errors, omissions, or discrepancies.

6.3 Images, Floor Plans, Virtual Staging, and Drone Footage

Photographs, videos, drone imagery, and virtual tours are intended to give a realistic representation of the property. Some images may be digitally enhanced or virtually staged to illustrate potential furnishings; such images will be clearly labelled where feasible. External views may be affected by weather or seasonal changes. We do not guarantee that the property will exactly match every visual representation.

6.4 Status Changes: Sold, Reserved, Coming Soon

Properties may be marked as “Coming Soon,” “Reserved,” or “Sold.” A “Coming Soon” listing is a pre-marketing indicator only; availability is not guaranteed. “Reserved” typically indicates an offer has been accepted and the property is under contract, pending due diligence. “Sold” means the transaction has closed. While we update statuses promptly, there may be a brief delay.

Customer-Friendly Explanation: Think of a listing as an invitation to explore. The real “yes” comes only after you’ve visited the place, checked the papers, and signed a formal agreement.

7. Property Enquiries, Viewings, and Appointments

7.1 General Enquiries and Response Times

You may submit enquiries through contact forms, email, WhatsApp, live chat, or telephone. We aim to respond within one business day, but during peak periods, response times may be longer. No binding agreement is created by an enquiry or an automated acknowledgement.

7.2 Site Visits and Property Viewings

Viewings are scheduled based on mutual convenience and are subject to property availability and seller/occupant consent. You must provide accurate contact information to confirm appointments. We reserve the right to request valid photo identification before or during the viewing. Children must be supervised at all times during property visits. You are responsible for your personal safety; we are not liable for accidents occurring during a site visit unless caused by our negligence. We may cancel or reschedule viewings due to force majeure or seller instructions.

7.3 Offer Submissions and Negotiations

Through our consultancy service, we may assist in formulating and submitting offers. All offers must be in writing and include proposed price, conditions, and timeline. Roblie Properties acts as an intermediary in relaying offers to sellers but does not guarantee acceptance. Negotiation discussions are confidential and may not be recorded or shared without consent. A formal acceptance of an offer typically requires a signed preliminary agreement and an earnest money deposit.

8. Property Transactions

8.1 Buying and Selling Through Roblie Properties

Roblie Properties provides brokerage and consultancy services to facilitate property transactions. Engagement of our services as a buyer’s or seller’s agent requires a separate written agreement. We do not hold client funds unless operating a regulated escrow arrangement or as explicitly authorized. All transaction-related legal work (title transfer, registration) should be reviewed by your independent legal counsel; we can recommend trusted lawyers but assume no liability for their advice.

8.2 Documentation, Due Diligence, and Title Verification

We assist in gathering necessary documents—title deeds, tax receipts, encumbrance certificates, etc.—and may coordinate due diligence. However, ultimate responsibility for verifying ownership, absence of liens, and land record authenticity rests with you, the buyer or seller. We strongly recommend a full title search by a qualified legal professional. Our role is facilitative, not a guarantee of title.

8.3 Government Approvals, Registration, and Taxes

Property transactions in Pakistan involve various government approvals (development authorities, cantonment boards, etc.) and the payment of taxes—including Capital Gains Tax, Withholding Tax, Stamp Duty, and CVT. Roblie Properties can provide general guidance on typical tax obligations but does not provide tax advice. You are responsible for paying all applicable taxes and registration fees, and for compliance with FBR and provincial revenue authority regulations.

8.4 Closing and Property Handover

The closing process culminates in the registration of the sale deed and the physical handover of possession. We coordinate with legal representatives, the escrow agent (if any), and the relevant sub-registrar office to ensure a smooth closure. Disbursement of sale proceeds to the seller and commission to Roblie Properties typically occurs simultaneously with or immediately after registration, as per the signed agreement. Any post-handover defect claims are generally a matter between buyer and seller, unless a structural warranty has been explicitly provided by the developer.

9. Overseas Buyers and International Services

9.1 Cross-Border Enquiries and Remote Transactions

We welcome overseas Pakistanis and international investors. The Website and digital communication channels are designed to facilitate remote property selection. However, remote transactions carry inherent risks. We strongly advise an in-person inspection or at minimum an independent local representative to verify the property. Virtual tours, video calls, and drone footage provide support but cannot replace physical diligence.

9.2 Power of Attorney, Identity Verification, and Foreign Documentation

Overseas buyers often transact through a Power of Attorney (POA) executed in favour of a trusted relative or lawyer in Pakistan. We recommend the POA be attested by the Pakistani embassy or consulate in your country of residence. We will require a copy of your NICOP, passport, and the POA for identity verification. All foreign documents must be translated into English or Urdu if requested.

9.3 Currency, Travel, and Communication

We may provide estimates of property values in foreign currencies (USD, GBP, AED, SAR, etc.) based on prevailing market rates; these are not firm quotes. You are responsible for complying with the foreign exchange regulations of both Pakistan and your country of residence, including obtaining necessary tax clearance certificates for remittance. We use WhatsApp, Zoom, and international calls for communication; you bear your own communication costs.

Important Notice: International real estate transactions can be complex. Engage local legal counsel early.

10. Payments, Fees, and Refunds

10.1 Applicable Charges and Invoices

Roblie Properties may charge for certain premium services—such as property valuation reports, professional photography packages, or featured listing placements—as per the rates agreed in a separate service order. These charges are in addition to any commission. Invoices will clearly state the service, amount, and payment terms.

10.2 Payment Terms, Late Payments, and Failed Payments

Payment for services is due as specified in the invoice, typically within 7–15 days. Late payments may incur a surcharge at the rate of 1.5% per month or the maximum allowed by law, whichever is lower. If a payment fails due to insufficient funds or incorrect details, you remain liable for the due amount plus any bank charges and recovery costs.

10.3 Refund Policy and Disputes

Fees for services rendered (e.g., completed valuation reports, photography already delivered) are non-refundable. Booking fees for property reservations are subject to the terms of the specific reservation agreement. If you have a payment dispute, contact our accounts department within 10 days of the invoice date. We will investigate and, if an error is found, issue a credit or refund.

11. Commission Policy

11.1 Commission Calculation and Payment Timing

Our commission is earned and payable upon the successful closing of a property transaction facilitated by Roblie Properties. The rate is agreed in a signed commission agreement, typically a percentage of the transaction value (commonly 1%–2% for each side in Pakistan), or a fixed amount as negotiated. Commission is due at the time of registration or as specified in the agreement. No commission is payable if a transaction does not close, unless a separate retainer agreement applies.

11.2 Buyer, Seller, and Broker Cooperation

In co-brokerage scenarios, commission is split as per a pre-agreed formula between cooperating brokers. Roblie Properties will disclose the involvement of other brokers. If you have previously engaged another agent under an exclusive agreement, you must disclose this; we are not responsible for any commission conflict arising from your failure to do so.

11.3 Commission Disputes and Recovery

If a buyer and seller circumvent Roblie Properties after introduction to transact privately without our knowledge, we reserve the right to claim the full agreed commission, plus recovery costs. In case of a commission dispute, we encourage mutual negotiation; if unresolved, the matter shall be settled as per the dispute resolution clause.

12. Intellectual Property

12.1 Website, Brand, and Content Ownership

The Website and all its original content—including text, graphics, logos, icons, images, audio clips, video clips, digital downloads, data compilations, and software—are the exclusive property of Roblie Properties or its content suppliers and are protected by Pakistani and international intellectual property laws. The compilation of all content on the Website is the exclusive property of Roblie Properties.

12.2 Photography, Videos, Floor Plans, and Marketing Materials

All property photography, drone footage, virtual tours, floor plans (custom), brochures, and marketing copy produced by Roblie Properties are our copyrighted works. You may not reproduce, distribute, modify, or create derivative works without our written consent. Sellers granting us permission to market their property retain ownership of their own pre-existing images, but grant us a worldwide, royalty-free licence to use them in connection with the property sale.

12.3 User-Generated Content Licensing

By submitting content (reviews, comments, testimonials, uploaded images), you grant Roblie Properties a non-exclusive, perpetual, irrevocable, royalty-free, transferable, sub-licensable licence to use, reproduce, modify, adapt, publish, and display such content in any media now known or later developed, for purposes related to our business. You represent that you own or have the necessary permissions for any content you post.

Business Explanation: Protecting our IP ensures that our luxury brand identity, high-quality visual assets, and marketing investments are not diluted or misappropriated.

13. User Content: Reviews, Comments, Testimonials, and Uploads

13.1 Ownership and Licence Grant

You retain ownership of the content you create. However, as described in Section 12.3, you grant us a broad licence. This allows us to feature your testimonial in marketing materials, display your property review on the Website, or share your uploaded photo (with proper attribution if requested) across our social media.

13.2 Moderation and Removal Rights

We do not pre-screen all user content but reserve the right (not the obligation) to monitor, edit, or remove any content that violates these Terms. We may remove content that is unlawful, defamatory, obscene, threatening, infringing on intellectual property, or otherwise objectionable. We may also remove content that appears to be fake, incentivised, or posted by competitors.

13.3 Prohibited Content Standards

You agree not to post:

  • False or misleading reviews.
  • Content containing hate speech, harassment, or discrimination.
  • Pornographic or sexually explicit material.
  • Content promoting illegal activity.
  • Spam, links to malicious sites, or unsolicited advertising.

Violation may lead to immediate account suspension and, if necessary, reporting to authorities.

14. AI-Assisted Features

14.1 AI Search, Recommendations, and Chat

Our Website may incorporate AI-driven tools—such as intelligent property search, personalised listing recommendations based on your browsing behaviour, and automated chat assistants. These tools are designed to enhance user experience by providing faster, more relevant property suggestions and answering common queries.

14.2 Limitations and No Professional Advice

AI-generated responses and recommendations are algorithmic outputs based on available data; they do not constitute professional real estate advice, legal opinion, or a substitute for a human consultant. Always verify critical information with a qualified team member. We do not guarantee the accuracy, completeness, or appropriateness of AI-suggested properties for your specific circumstances. By using these features, you accept that Roblie Properties is not liable for decisions made in reliance on AI output alone.

15. Privacy and Data Handling

Your privacy is critically important to us.
